PATENT REGISTRATION PROCEDURE
IN OMAN

Oman, officially the Sultanate of Oman, is a key Western Asian nation bordering Saudi Arabia, UAE, and Yemen. It has significant geopolitical influence as a member of the UN, Arab League, GCC, and OIC. With a high-income economy driven by oil exports (82.2%), tourism, and trade, Oman is rapidly expanding its tourism sector. A free trade agreement with the US enhances investment opportunities. In 2017, FDI reached $24 billion, led by the UK (48%), with oil and gas dominating investments.

Patents in Oman

In Oman, patents grant inventors exclusive rights to their innovations, governed by Royal Decree 82/2000. Eligible inventions must be new, innovative, industrially applicable, and not conflict with public order, morals, national security, or Islamic Shari’a principles. Applications are submitted to the Department of Agencies and Intellectual Property at the Ministry of Commerce and Industry. Patent holders can use, manufacture, import, or sell their patented products, while unauthorized use by third parties is prohibited. Breaches of patents can lead to civil and criminal penalties.

At the time of filing of the patent application, the applicant is required to file:

  • Applicant’s name and address and Inventor’s name and address.

  • Abstract, Specification, claims and drawings (if any) in English & Arabic.  In case, the complete Arabic translation is not ready at the time of filing the application, the inventor can file the application with Arabic translation of the Abstract and Title.

  • Priority Application Number and filing date, PCT Application Number and Filing date (if any)

  • Original Power of Attorney duly notarized and legalized either by the Apostille or legalized by the Consulate of Oman.

  • Deed of Assignment executed by the inventor(s), assigning their patent rights to the applicant

  • A certified copy of the priority document (along with a simple English translation), if it is a national filing.

  • A valid simple copy of the Certificate of Incorporation of the applicant company or an extract of their entry in the Commercial Register or a Certificate of Good Standing (along with a simple English translation, if the document is not in English).
