TRADEMARK PROTECTION AND REGISTRATION IN THE BAHRAIN
In Bahrain, trademarks are used to distinguish goods, products, or services, and can include names, logos, sounds, or smells. Applications are submitted to the Trademark Office for nationals or residents, while foreign applicants must go through authorized IP agents. The protection period for a trademark is 10 years from the filing date, with the option to renew. The GCC Trademark Law, ratified in 2014, governs trademark registration in Bahrain. Trademarks must be distinctive and not cause confusion.
Marks that lack distinctiveness, violate public morals, or mislead consumers about the origin of goods or services cannot be registered.
Although not mandatory, conducting a trademark search is crucial to avoid potential conflicts with existing trademarks. Bahrain does not allow multi-class applications, so separate filings are required for each class. Nationals can file directly with the Industrial Property Directorate, while foreign applicants must use authorized IP firms in Bahrain.
