TRADEMARK PROTECTION AND REGISTRATION IN THE UAE

In the UAE, trademarks are protected under Federal Law No. 37 of 1992, encompassing names, words, logos, patterns, and even accompanying sounds used to distinguish goods, products, or services. The Ministry of Economy handles trademark registration, and applications can be submitted online via its website.

For obtainment of the filing date, the UAE trademark application must contain:

• Application Requirements: TM request, applicant info, goods/services list, trademark image.

• Priority Document: Certified copy with Arabic/English translations required upfront.

• Power of Attorney: Submit original within 30 days; UAE Consulate legalisation needed.

• Local Legalisation: Handled by local agent via UAE Ministry of Foreign Affairs.

According to Federal Law No. 37 of 1992 on Trademarks as amended (Arabic), the following persons can register their trademarks:

• UAE Citizens: Individuals or entities in commercial, industrial, or service sectors.

• Foreign Businesses: Individuals or entities operating in relevant sectors.

• Reciprocity Basis: Foreign entities from countries with mutual agreements.

• Other Entities: Any other artificial persons.

• Publication: Accepted trademarks announced in the Bulletin and two Arabic dailies (at applicant’s cost).

• Objections: Must be submitted within 30 days via written, registered, or electronic mail.

• Notification: Ministry informs the applicant within 15 days of receiving objections.

• Response Deadline: Applicant must reply within 30 days; failure to respond implies withdrawal.

Duplicate of the mark.
Description of the products, goods or services for which the mark is designated and their category.
Number and date of the international priority right and name of the State Member in Paris Convention for the Protection of the Industrial Property, where the priority right application has been lodged.

The term of the letters patent shall be a period of twenty years, and ten years for the utility certificate as of the date of filing the application. An annual fee shall be payable on the letters patent or the utility certificate and shall be paid by the beginning of each year starting from the year following the date of filing the applications related. If such a fee has not been duly paid by the owner of the letters patent within a three-month period, then another grace period of three months shall be allowed, within which time the due fee is to be paid, provided that a late - fee shall be added.

In all instances, the annual fees may be paid in advance for the entire term of the letters patent or the utility certificate or for parts thereof. If the fee is not duly paid by the owner of the letters patent or by the holder of the utility certificate within the prescribed period indicated herein (six months from the due date), the letters patent or the utility certificate shall then lapse.
